Work Permit and Form I-765 Basics
A work permit allows eligible non-citizens to legally work in the United States. USCIS grants a work permit by approving Work Permit Form I-765, Application for Employment Authorization. While a work permit authorizes employment, it does not grant, extend, or maintain immigration status. Instead, lawful presence in the United States depends on the underlying visa or immigration benefit, not the work permit itself.
Many different applicants use Form I-765, and eligibility depends on the category connected to each person’s immigration situation. Therefore, filing under the wrong category can lead to delays or even a denial. For that reason, understanding how work permit categories function is extremely important.
Work Permit I-765 Basics
A USCIS work permit, also called an Employment Authorization Document (EAD), serves as evidence that USCIS has authorized employment for a specific period. Some individuals automatically receive work authorization because of their immigration status; however, they still apply for an EAD to prove their authorization to employers.
Every work permit issued through Form I-765 has a limited validity period. USCIS decides how long the work permit remains valid based on the applicant’s eligibility category and underlying immigration benefit. Consequently, a work permit does not authorize employment beyond the expiration date printed on the card.
Work Permit Category for Adjustment of Status
Applicants who file Form I-485 to adjust status to permanent resident may also apply for a work permit under category (c)(9). This category allows them to work while USCIS reviews the adjustment application. However, the work permit does not provide lawful status and does not replace a valid nonimmigrant status.
Work Permit Categories for Asylum Applicants
Individuals with a pending asylum application may apply for a work permit under category (c)(8) after they satisfy the required waiting periods. In addition, individuals who receive asylum may apply under category (a)(5). Employment authorization in asylum cases depends on maintaining eligibility and complying with all asylum-related requirements.
Work Permit Categories for Temporary Protected Status
Nationals of countries designated for Temporary Protected Status (TPS) may apply for a work permit under categories (a)(12) or (c)(19). However, these work permits remain valid only while TPS remains in effect. Additionally, applicants must complete timely re-registration whenever DHS announces extensions or redesignations.
Work Permit Category for Parole
Individuals who enter the United States through humanitarian or public-interest parole may qualify for a work permit under category (c)(11). Furthermore, the validity of the work permit generally matches the parole period that USCIS grants.
Work Permit Category for DACA
Recipients of Deferred Action for Childhood Arrivals (DACA) may apply for a work permit under category (c)(33). Because DACA work permits are issued for limited periods, recipients should renew them on time to avoid gaps in employment authorization.
Work Permit I-765 Validity Periods and Renewals
Every work permit has a specific expiration date. USCIS determines the validity period according to the applicant’s eligibility category and current policy guidance. Therefore, filing a renewal application before the work permit expires is essential to avoid losing authorization to work.
In limited situations, USCIS automatically extends employment authorization for certain renewal applicants. For example, renewal applications filed on or before October 29, 2025, may qualify for up to 540 days of automatic extension if the applicant meets all requirements. However, renewal applications filed on or after October 30, 2025, generally do not receive this extended protection unless USCIS announces future changes.
